1. INTRODUCTION
These Terms & Conditions (“Terms”) govern your use of the Luz Quarter website, your purchase of pool memberships, and your use of any services provided by Luz Quarter (“we,” “us,” or “our”).
By purchasing a membership, accessing the pool, using a digital pass, or interacting with our website, you agree to be bound by these Terms, our Privacy Policy, and any supplemental rules posted on-site or online.
If you do not agree to these Terms, you may not use our services.
2. SERVICES PROVIDED
Luz Quarter provides seasonal and annual pool memberships for property owners, residents, and guests in the Luz area. Services may include:
- Access to Luz Quarter pool facilities
- Issuance of digital passes (Apple Wallet / Google Wallet)
- Guest registration tools for property owners
- Customer support and account management
We reserve the right to modify, suspend, restrict, or discontinue any part of the service at any time.
3. MEMBERSHIP TYPES & VALIDITY
Membership offerings may vary. Current membership categories include:
3.1 Property Membership (Seasonal)
- Valid January 1 – December 31 of the applicable year.
- Access granted to guests staying in the associated property.
- Buyer must provide the correct property address.
- Pass indicates the maximum number of guests (2–6) assigned at purchase.
- Membership applies to the property, not a specific individual.
- Only one property membership is permitted per order.
3.2 Individual Resident Membership (12 Months)
- Valid for 12 months from the date of purchase.
- Requires Portuguese residency verification (e.g., NIF or proof of address).
- Pass is personal and non-transferable.
3.3 Weekly Guest Add-On (Optional)
- For property owners only.
- Valid for one week at the dates selected.
- Provides access for one additional guest.
We may modify membership categories or eligibility without prior notice.
4. POOL ACCESS RULES
To protect the safety and enjoyment of all guests:
- Access is granted only through valid digital passes.
- Passes must be shown to staff at entry.
- Staff may deny access to individuals not covered by the membership.
- We reserve the right to refuse entry for improper behavior, overcrowding, safety concerns, or misuse of passes.
- Children must be supervised at all times; responsibility remains with the accompanying adult(s).
- Glass, dangerous objects, or prohibited substances are not allowed in pool areas.
Failure to comply may result in temporary or permanent suspension of access.
5. DIGITAL WALLET PASSES
All memberships are delivered digitally.
5.1 Issuance
- Passes are issued after purchase via email with an Apple/Google Wallet link.
- Property pass links may be shared with guests staying at the property.
5.2 Restrictions
- Passes may not be sold, transferred, or shared outside of the authorized property or household.
- Abuse of a pass (e.g., exceeding guest limits, unauthorized sharing) may result in immediate cancellation without refund.
Digital passes remain the property of Luz Quarter and may be deactivated at our discretion for security, misuse, or non-compliance.
6. GUEST REGISTRATION (PROPERTY MEMBERSHIPS)
- Property owners are responsible for submitting the names of guests before each stay via the Guest Registration Form.
- Guest lists are used for operational and security purposes only.
- We may refuse entry to unregistered guests if the information provided is incomplete or inaccurate.
7. PRICING, PAYMENTS & TAXES
- All prices are listed in Euro (€) and subject to IVA (VAT) according to Portuguese law.
- Payments are processed securely through approved payment providers (e.g., WooPayments, Stripe).
- We do not store full payment card details.
- Prices may be updated at any time.
- Membership fees must be paid in full at the time of purchase.
8. REFUNDS & CANCELLATIONS
To maintain fairness and operational consistency:
8.1 No Refunds
All membership sales are final and non-refundable, including but not limited to:
- Changes in personal circumstances
- Weather or temporary pool closures
- Missed usage or limited availability
- Errors in guest count or dates submitted by the user
- Loss or deletion of digital passes
8.2 Changes to Membership Details
We may, at our discretion, correct minor mistakes (e.g., property address typo) but are not obligated to modify guest counts, dates, or pass types after purchase.
9. ACCOUNT RESPONSIBILITIES
If you create an account:
- You must provide accurate and complete information.
- You are responsible for maintaining account confidentiality.
- Unauthorized account access should be reported immediately.
We reserve the right to suspend accounts for misuse or violation of these Terms.
10. SERVICE AVAILABILITY & LIMITATIONS
We aim to keep services available but do not guarantee:
- Continuous or error-free website operation
- Continuous pool availability
- Uninterrupted digital pass functionality
- Specific opening hours, which may change seasonally
Planned or unplanned maintenance may cause temporary disruptions.
11. LIABILITY LIMITATION
To the maximum extent permitted by law:
- Luz Quarter is not liable for damages arising from use of the pool, website, passes, or services.
- Users assume all risks associated with physical activities within the facility.
- We are not liable for:
- Loss of personal belongings,
- Injuries due to misuse of facilities,
- Issues caused by third-party providers,
- Interruptions caused by maintenance or environmental factors.

Our total liability shall not exceed the amount paid for the membership in question.
12. USER CONDUCT
You agree not to:
- Misuse or tamper with digital passes
- Provide false or misleading information
- Share property passes outside the authorized group
- Engage in unsafe or disruptive behavior at the pool
- Circumvent membership or access rules
Violations may result in suspension or termination of membership without refund.
13. INTELLECTUAL PROPERTY
All content, branding, designs, and materials on the Luz Quarter website are protected intellectual property. Users may not reproduce or distribute content without written permission.
14. THIRD-PARTY SERVICES
Our services rely on third parties, including:
- Payment processors
- PassKit for digital passes
- Hosting providers
- Analytics vendors
We are not responsible for their availability or performance.
15. CHANGES TO TERMS
We may update these Terms at any time.
Changes take effect immediately upon posting.
The “Last revised” date at the top reflects the most recent update.
Continued use of the website or services constitutes acceptance of updated Terms.
16. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by Portuguese law.
Any disputes will be resolved:
- First through informal negotiation; then
- If necessary, through the competent courts of Portugal.
